Smartphones, websites and other connected devices are increasingly requesting that consumers provide their geolocation information. Entities that collect, use or share this information, however, need to consider privacy issues and restrictions, as evidenced by the orders the FTC issued on March 26, 2019, to seven U.S. internet broadband providers seeking information about their privacy practices around location and other sensitive data. In this first installment of our two-part series on tackling geolocation data privacy issues, we discuss how geolocation data is used and why it is so sensitive, as well as the applicable laws, regulatory enforcement and litigations. Part two will provide practical advice on mitigating risk surrounding the use of geolocation data. See “Staying Current With Geolocation Restrictions” (Aug. 1, 2018).
